241. Today I went to my MP Matthew Green’s office and asked for an update to my case from Trudy. The woman at the front desk said Trudy is leaving because she has an appiontment. She then said Trudy will call you.

243. Today I filed a complaint against Trudy of my MP Matthew Green’s office with the Office of the Public Sector Integrity Commissioner.

Update of January 31, 2025,

244. Because when I wrote to the Ontario Attorney General I did not tell them what my Lawyer said about section 5c of the MOU between the OIPRD and the AG. Today I wrote to them again saying.

In the past I have asked you to investigate the OIPRD for covering up complaints against police. Because section 5c of the Memorrandum of understanding between the OIPRD and the AG says The Director is accountable to the Attorney General for the performance of the OIPRD in fulfilling its mandate and for carrying out the roles and responsibilities assigned to the Director by the PSA, Management Principles, all Directives, and this MOU. Your staff have said that section 5c of the MOU does not mean that the AG can investigate the OIPRD. And told me to see a Lawyer. So, I hired a lawyer and asked him what does section 5c of the MOU mean. He said after reading section 5c of the MOU he cannot see how the AG could not investigate the OIPRD if they choose to. (see below for the email from my Lawyer.

So, can you please investigate the OIPRD for covering up complaints against police?

Update of February 05, 2025,

245. I have received a responds from Office of the Public Sector Integrity Commissioner. Saying Please note that the Commissioner’s Office does not have jurisdiction over Members of Parliament or their employees, as they are not included in the definition of public sector under the Act. As such, the Commissioner’s Office does not have jurisdiction over Mr. Green’s office or employees.

Update of February 05, 2025, at 7:00 pm

246. Today I wrote to the Premier of Ontario Doug Ford saying.

In 2021 I wrote to the Attorney General of Ontario and asked them to investigated the OIPRD because section 5c of the Memorandum of understanding between the OIPRD and the Attorney Genera of Ontario says

The Director is accountable to the Attorney General for the performance of the OIPRD in fulfilling its mandate and for carrying out the roles and responsibilities assigned to the Director by the PSA, Management Principles, all Directives, and this MOU.

The AG’s office said that section 5c of the MOU does not mean that the AG can investigate the OIPRD because the OIPRD are independent of the Government. They then said you need to talk to a Lawyer for legal advise. So, I hired a Lawyer and asked him what does section 5c of the MOU mean. After reading section 5c my Lawyer said that he cannot see how the AG cannot investgate the OIPRD.

The AG’s office did not launch an investigating into the OIPRD nor did they say that my Lawyer is wrong in what he is saying.

I have written to you about this in the past but you have said that you cannot comment on the OIPRD because they are independent from the government.

If the AG can investigate the OIPRD but refuse to do so without giving a reasonable explaination as to why not. Surely you can fire the AG for this even if the OIPRD are independent from the Government?

Update of February 11, 2025,

247. Some people have emailed me saying that they do not want to write to government officials or the news media who are giving me the run around because they are afraid of retaliation from the police. I have never been arrested because of the staff on my website. The reason that the police arrested me when I was arguing with my parents was because they wanted to separate me and my parents that night so, they did not have to come back again. The reason the police arrested me at city hall is because I said I would go back into the police services board meeting and interrupt it again after they gave me the ticket for trespass.  No one has retaliated against me because of the staff on my website!!!

Update of February 14, 2025,

248. Today I sent a registered letter to MP Matthew Greens home address saying.

Dear Matthew

Your staff member Trudy said she wrote to the RCMP Public Complaints Commission about their refusal to review my complaint against an RCMP member. I do not believe that she did write to the Commission. I asked her to forward those emails to me to prove she did. She said that it is against our policy to give out our emails. I believe that she is afraid of the police so, that is why she does not want to help me. You can make her change her policy because you are her boss.

A rule says you have to help your constituents with problems with the Federal government agencies  Here is the rule.

Responsibilities and Conduct of Members

Members sit in the House of Commons to serve as representatives of the people who have elected them to that office. They have wide-ranging responsibilities which include activities in the Chamber, committees and their constituencies. It is said that:

The member of parliament represents his constituency through service in the House of Commons. This does not mean, however, that he spends most of this time sitting in the House, or even that attendance there is the most important part of his work. An MP spends far more of his working life outside the House than in it. … The job is people-oriented, involving talking about and listening to ideas, proposals, and complaints, reconciling opposing viewpoints, explaining party or government policy to citizens and citizens’ views to party and government, getting action out of the government on problems of constituents, and examining how the government uses or abuses the power it exercises on behalf of the people of Canada.281

Besides participating in debates in the Chamber and in committees, conveying their constituents’ views to the government and advocating on their behalf, Members also have responsibilities in many other areas:

They act as ombudsmen by providing information to constituents and resolving problems.

They act as legislators by either initiating bills of their own or proposing amendments to government and other Members’ bills.

They develop specialized knowledge in one or more of the policy areas dealt with by Parliament, and propose recommendations to the government.

They represent the Parliament of Canada at home and abroad by participating in international conferences and official visits.

The Criminal Code of Canada section 139 subsection 2 says

(2) Every person who intentionally attempts in any manner other than a manner described in subsection (1) to obstruct, pervert or defeat the course of justice is guilty of

(a) an indictable offence and liable to imprisonment for a term of not more than 10 years; or

(b) an offence punishable on summary conviction.

So, if you do not help me for the wrong reasons you are obstructing justice. And being afraid of the police is not the right reason to not help me.

Update of February 17, 2025,

249. On Saturday I sent an email to The Bay Observer in Hamilton saying.

My name is Robert Burgiss I own the website https://injusticeinontario.ca/ I filed a complaint against an RCMP officer. The professional standards unit of the RCMP denied my complaint. I then asked the RCMP public Complaints Commission to review the decision of the RCMP PSU. The Commission said your complaint cannot be reviewed—the RCMP Act section 45.7 (1) says that complaints can be reviewed. It does not say only some complaints can be reviewed. I have asked the Commission to tell me where it says that some Complaints cannot be reviewed but they did not answer my question.
I have been trying to get my website in the news so, something will be done about the corruption, but the news media are afraid to do it because they worry about being sued for defamation.
So, I am writing to ask you to do a news story about what the RCMP Complaints Commission said. But you do not have to mention my name or my website url address or the name of the officer that the complaint concerns or the details of the complaint. Just what the Commission said. That way you do not have to worry about the police suing you for defamation. RCMP Public Complaints Commission decisions are not final and can be reversed if wrong.

Robert a story like this that appears to have started 30 years ago, with a lot of he-said, she-said is difficult to do at the best of times, but for me working alone, I just can’t take it on. I simply don’t have the resources to devote to it.

Just do a news story about what the RCMP complaints Commission said. They said that my complaint cannot be reviewed. But the part of the RCMP act that they mention says

Duty to refuse or terminate investigation

(2) The Commissioner shall direct the Force to not commence or continue an investigation of a complaint by a member or other person appointed or employed under Part I if the complaint has been or could have been adequately dealt with, or could more appropriately be dealt with, according to a procedure provided for under this Act or any other Act of Parliament.

They say that means that the cannot do a review on my complaint. It does not say that it says to not commence or continue an investigation. It does not say to not commence or continue a review.

Sorry Robert, I cant make head nor tail of this saga. Youve obviously been living it for many years, and I presume have pitched it to other media as well. I simply, as a guy working alone, do not have the time it would take to properly investigate this matter.

Here is what you put in the story The The Civilian Review and Complaints Commission for the RCMP (CRCC) said that they cannot review my complaint. Because the RCMP act section 45.61 (2) says

Duty to refuse or terminate investigation

(2) The Commissioner shall direct the Force to not commence or continue an investigation of a complaint by a member or other person appointed or employed under Part I if the complaint has been or could have been adequately dealt with, or could more appropriately be dealt with, according to a procedure provided for under this Act or any other Act of Parliament.

It says to not commence or continue inestigation. It does not say to not Commience or continue review.

I do not understand why the news media are so afraid of the police. If the police were to retaliate against a reporter the reporter could put the retaliation in the news. So, the news media have a type of protection form that.
